Thank you for choosing the Yoga Now application offered by Yoga Now App and/or Platform, and/or its subsidiaries or affiliates (referred to as "Yoga Now", "we", "our", or "us"). Please carefully read these Terms of Service ("Agreement") thoroughly. This Agreement is a legal agreement between you and Yoga Now. By accepting electronically (for example, clicking "I Agree"), and subscribing to the app, you agree to these terms. If you do not agree to this Agreement, please do not electronically accept and subscribe to the application.

Yoga Now and Yoganowworld.com provide online yoga services via the Application. The following terms and conditions (the “Terms”) apply to our provision and your use of the services and materials (“Yoga Now services”) through the Yoga Now application.

Who we Are?

Yoga Now operates and provide online yoga services, through live Videos, challenge and educative ABS podcasts providing live yoga classes via zoom 24/7 daily. We also offer all kinds of music and DNA infused yoga abs Health and wellness Programs.

Our services is available in several countries, as well in California (US), Canada, United Kingdom, Spain etc. The Services is not intended for use by Users under the age of 18; you must be 18 years and older to use our app and services.

Legal Agreement

By using the Services, you state that,

you form a binding contract with Yoganowworld.com; you will comply with these Terms and all applicable local, state, and national laws, rules, and regulations; and you understand that Yoga Now is protected by relevant trademark and copyright laws.

User Eligibility

To access or use the application, you must be 18 years or older and have the requisite power and authority to enter into these terms. You may not access or use the application if you are a competitor of ours, have intentions of collecting or utilizing our content for your purposes, or if we have previously banned you from the application or closed your account. You have to be at least 18 years old. No exceptions. Use yoganowworld.com as much as you want, but you’re not allowed to resell the information, or other contents obtained, through the application.

No Professional Advice; Risk of Use

All information supplied through the site or by any Yoga Now Party is for informational purposes or general guidance and does not constitute medical or other professional advice. The site does not and is not intended to provide any information to diagnose, mitigate, prevent, treat, or cure any disease or condition. Health-related information provided through the site is not a substitute for professional medical advice. You must consult your physician or other healthcare professionals before making medical decisions related to the Yoga analysis provided to you. None of the information available through the site constitutes a recommendation or solicitation to take or not take any particular action.

The receipt of any questions or feedback you submit to Yoga Now. does not create a professional relationship. It does not make any privacy rights other than those described in Yoga Now.'s Privacy Policy. Further more, if you are experiencing a medical emergency, you should not rely on this platform for assistance but should instead seek appropriate emergency medical assistance.

Our Obligations

Yoga Now agrees to provide the Services substantially under these Terms and with a logical skill and care and applicable with all laws and regulations. This obligation shall not apply if any non-conformance is caused by use of the Services in breach of these Terms or contrary to Yoga Now’s instructions, or modification or alteration of the Services by you other than yoganowworld.com’s duly authorized partners.

Availability

The application may be modified, updated, interrupted, suspended, or discontinued at any time without notice or liability.

The User

The User may either be an Individual as defined hereinbelow and includes any person browsing and/or viewing the application, as well as creating an account.

Account

To access the application, the Users is required to create an account, (User Account) they will be required to provide current, accurate identification, contact, and other information ('Users Information') as part of the account registration process and/or continued usage of the Site offered by Yoga Now and its subsidiaries or affiliated companies. "Users Information" referred to hereinabove also includes but is not limited to any information provided by the Users to yoganowworld.com or other Users of the site. Furthermore, the Users’ Information and ID provided during the time of registration may not be transferred or sold to another party.

The Users is responsible for maintaining the confidentiality of their account and password and for restricting access to their devices, which includes but is not limited to computers, mobile devices, and/or any other device a substantial purpose of which is facilitating telephonic communication, but which also incorporates functionality that allows viewing of the Sites and its contents. The Users agrees to accept responsibility for all activities that occur under the Users’ account or password.

Yoga Now reserves the right to refuse service, terminate accounts, remove or edit contents, and/or cancel orders in Yoga Now’s sole discretion.

Data Collection

Using the service may require you to submit information and content to the Yoga Now Services, such as PHI (patient health information), healthcare services related data, communications and usage data, all of which qualifies as ‘User Data’. All data collected on the yoganowworld.com platforms complies with The Health Insurance Portability and Accountability Act of 1996 (HIPAA) Requirements.

Mobile Data Fees & Usage

Yoga Now is not responsible for any fees or usage charges related to your access to the Yoga Now Platform. Your mobile network’s data and messaging rates and fees may apply if you access or use the yoganowworld.com Platform from a device. You are solely responsible for acquiring and updating compatible hardware or devices necessary to access and use the Yoga Now Platform and any updates to it. Yoga Now does not guarantee that the Yoga Now Platform, or any portion thereof, will function on any particular network, hardware, or device

Termination and Suspension

Yoga Now reserves the right to immediately suspend or terminate its service to the Users without warning and/or notice for violation or breach of any of the terms and conditions in this Agreement.

If we suspect any actual fraud or a security breach concerning your Yoga Now Account with us, we will suspend your account and you will be notified.

Yoga Now reserves the right to refuse service, terminate accounts, remove or edit contents, and/or cancel orders at Yoga Now’s sole discretion.

Subscription Plans

This application is a pay before access services which will require you to pay a fee to use them. We provide monthly subscription service. Except as expressly set forth below, all fees are payable with taxes included.

Privacy Data

Our Privacy Policy provides more information regarding how we collect, use, and disclose your personal information. By using the App or any of the Services, you agree to Yoga Now collection and use of technical information obtained through your Device and related software and hardware.

In the course of providing the services, Yoga Now may create health related analysis using information derived from your use of the Services, however, such analysis will not include any personal data you acknowledge that we will collect, use and disclose your personal information as described in our Privacy Policy. Please see our Privacy Policy page for more information.

Refund and Cancellation Policy

As a subscriber and user of the Yoga Now services you can send a cancellation request at anytime. However, you will not be refunded of any unused subscription plan. Any cancellation request after the service has begun will result in our no refund policy.

If you dispute any payment you have made to us for our services (by, for example, initiating a chargeback), we now reserve the irrevocable right to:

Temporarily suspend or permanently terminate your account with us; and Rescind any or all services you purchased from us.

If we decide to cancel an order for a refund, your payment method will be refunded. If you engage in any fraudulent activity through or concerning the website or our services (e.g., by placing orders using a stolen credit card’s information), we will immediately terminate your account with us; no exceptions.

Your Contributions

We created this set of rules to protect the activity on our website and services. Please read them carefully, for it makes up the conditions for using our Platform. Zero tolerance to Illegal Activity: we do not allow illegal activity on the Platform. Each of your actions and contents posted or uploaded via the Platform must not violate any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries) No Fraud: we do not tolerate Fraud in any capacity No Interference. You may not interfere with any other user's ability to use or enjoy our Services. No Bullying. You may not use our Services to threaten, abuse, harass, or invade the privacy of any third party.

Content Posted by You Must be Yours. You may not upload, post, transmit or otherwise distribute or facilitate the distribution of content that is fraudulent or infringes on the rights of any third party, including, without limitation, patent, trademark, copyright, right of publicity, or other proprietary rights.

Your Materials Must Be Lawful and Appropriate. You may not upload, post, or otherwise distribute or facilitate any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, profane, indecent, or otherwise inappropriate information of any kind, including, without limitation, any images or other material of a sexual nature.

Don't Damage Our Services or Servers. You may not post or facilitate the distribution of software viruses or any computer code designed to disrupt, damage, or limit our Services' or obtain unauthorized access to our Services or Content or any data or other information of any third party. No Unauthorized Access. You may not attempt to gain unauthorized access to other computer systems or networks connected to our Services or use our Services, Content, or any information contained therein for any unlawful purpose. yoganowworld.com, in its sole and absolute discretion, shall determine whether any content you transmit or receive or your use of our Services violates this provision.

No Collection of Personal Information from Other Users. You may not collect information about other users of our Services or use any such information to transmit or facilitate the transmission of unauthorized or unsolicited advertising, junk or bulk Email, chain letters, or any other form of unauthorized solicitation.

Be Yourself. You may not impersonate or falsely state or otherwise misrepresent your professional or other affiliation with any other person or entity. No Criminal or Unlawful Conduct. You may not use our Services, Content, or any information contained therein for any unlawful purpose, and you may not encourage conduct that would constitute a criminal offense or give rise to civil liability. You may not use any of our Services in connection with any site or other use that contains or is associated with information or content prohibited by this section.

Follow These Terms of Use and Conduct Rules. You may not take any action on or through our Services that violates any applicable law or these Terms of Use. If You violate these platform guidelines, we reserve the right to remove You and any of Your Content from the yoganowworld.com Platform. Whether conduct violates, our rules of conduct will be determined in yoganowworld.com's sole discretion. Intellectual Property Rights

Yoga Now retains all right, title, and interest in the performance of the services, including response times, load averages, usage statistics, and activity logs, (collectively, “Usage history”) Usage Information, and any derivative works thereof. You will not copy or transmit any of the material except if you are doing so for your personal, non-commercial use. Your use of and access to the Yoga Now application does not grant you any license or right to use any of the marks included on our application.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YOGA NOW, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. UNDER NO CIRCUMSTANCES WILL YOGA NOW BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOGA NOW ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL YOGA NOW, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO COMPANY HEREUNDER.

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

The Service is controlled and operated from facilities in the United Kingdom. Yoga Now makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable United Kingdom and local laws and regulations, including but not limited to export and import regulations. You may not use the Service if you are a resident of a country embargoed by the United Kingdom, or are a foreign person or entity blocked or denied by the United Kingdom government. Unless otherwise explicitly stated, all materials found on the Service are solely directed to individuals, companies, or other entities located in the United Kingdom.

Integration

We may make available functionality allowing you to log in, create or perhaps access Yoga Now through other third-parties, (“Integration Service”) via Yoga Now services. Usage of such services will be governed by the Terms applicable for the Integration Service used.

When using the Service or third-party integrations to the Service, you may be exposed to promotions and advertisements. These links are provided solely as a convenience to you and not as an endorsement by Yoga Now of such third party services. Yoga Now excludes any responsibility for the content of linked third party sites.

Indemnify Us

Subject to these terms, you will defend, indemnify and hold us and each of our officers, directors, employees, and agents harmless from and against any claim, cause of action, liability, expense, loss, or demand, including—without limitation—reasonable legal and accounting fees, arising out of, or in any way connected with your breach of these terms or the agreements made part of these terms by reference, your breach of any applicable law, and your use of or access to our application, our paid services or the intellectual property.

Links to Third Party

The Sites may contain links and/or references to other websites and applications ('Third Party applications'). Yoga Now shall not be responsible for the contents, accuracy, and/or opinions expressed in Third Party applications (which are not investigated, monitored, or checked for accuracy or completeness by Yoga Now). Inclusion of and/or reference to any links or internet addresses on the Sites do not imply approval or endorsement of those sites by Yoga Now. In the event the Users decides to leave the Sites and access Third Party Sites, the Users does so at his/their own risk.

Waiver; Remedies:

The failure of Yoga Now to partially or fully exercise any rights or the waiver of Yoga Now of any breach of these Terms and Conditions by you shall not prevent a subsequent exercise of such right by yoganowworld.com or be deemed a waiver by Yoga Now of any subsequent breach by you of the same or any other term of these Terms and Conditions. The rights and remedies of Yoga Now under these Terms and Conditions and any other applicable agreement between you and Yoga Now shall be cumulative, and the exercise of any such right or remedy shall not limit Yoga Now's right to exercise any other right or remedy.

Communications

For contractual purposes, you (a) consent to receive communications from Yoga Now in an electronic form via the email address you have submitted; and (b) agree that all terms and condition, agreements, notices, disclosures, and other communications that Yoga Now provides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights. Yoga Now may also use your email address, to send you other messages, including information about Yoga Now features and special offers. You may opt-out of such email by changing your account settings or sending an email to

Opting out may prevent you from receiving messages regarding Yoga Now services or special offers.

End-User Agreement

When you create a user account or download the Yoganowworld.com mobile application to enable you to access the services, you will be required to agree to an End User Agreement that will govern our license to you of the mobile application and your use of the services we provide. Should there be a conflict between these Terms of Service and the End User Agreement concerning any specific subject matter, the End-User Agreement will prevail for that specific subject matter.

No Reliance

You should not solely rely on the Material, but should instead seek other opinions before taking or failing to take any action which could lead to injury, harm, death, or damage of any kind.

General Data Protection Regulation (GDPR)

By using the Website, app, or services, you agree to the Yoga Now collection and processing of personal data. As a result, the User authorize Yoga Now and its subcontractors to collect and process this data under the United Kingdom Data protection regulatory, (hereinafter " the United Kingdom Data Protection Act ") and the GDPR provisions. To this end, Yoga Now’s Data Protection Officer (DPO) constantly ensures compliance of all personal data processing in progress within Yoga Now operations.

Also, Yoga Now certifies the following:

It has implemented appropriate technical and organizational measures to ensure and be able to demonstrate that the processes are carried out under the GDPR Regulation when it acts as the data controller. It provides sufficient guarantees as to the implementation of appropriate technical and organizational measures so that any processing of personal data meets the requirements of the GDPR and guarantees protection of the rights of the person in question when acting as a subcontractor. In the event of subcontracting, it retains only those subcontractors who provide sufficient guarantees that appropriate technical and organizational measures will be implemented so that any processing of personal data meets the requirements of the GDPR and guarantees protection of the rights of the person in question Lastly, Yoga Now undertakes to implement appropriate technical and organizational measures to retain personal data for the duration stipulated depending on the nature of said data.

Yoga Now is committed to protecting the data of its users. By using the Yoga Now Services, You acknowledge and agree that Yoga Now will collect, use and disclose some of this personal information and this process is governed by our Privacy Policy.

Feedbacks

We encourage you to share your comments and questions with us, but we may not be able to respond to all of them. Please note that we assume no responsibility for reviewing unsolicited ideas for our business (like the product or advertising ideas) and will not incur any liability as a result of any similarities between those ideas and materials that may appear in future Yoga Now products or services. Also, please remember that you are responsible for whatever material you submit, including its reliability, originality, and copyright. Please do not reveal trade secrets or other confidential information in your messages. Any rights to materials submitted to us become the exclusive property of Yoga Now. Furthermore, by submitting feedback, you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide license (with the right to freely sublicense) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise

Governing law and Disputes

These terms and conditions and your use of the Yoga Now application are governed by the United Kingdom Laws Including the required European Union GDPR Regulation. If you are a user and habitually reside in the United States, the United Kingdom laws will apply to any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms ("claim") or services. Any dispute between the parties that is not subject to arbitration or cannot be heard in small claims court will be resolved by arbitration.

Miscellaneous

Yoga Now may modify the terms herein contained at any time. Such modifications shall be communicated by e-mail and shall be binding on you. 

Yoga Now's opinion on all issues about interpreting these Terms shall be final and binding on you. Yoga Now is subject to existing laws and legal process. Nothing contained in these Terms is in derogation of Yoga Now's right and obligation to comply with the law or governmental, court, and requests of enforcement agencies. Yoga Now recognizes and complies with the EU GDPR, the United Kingdom Data Protection Laws, the U.S HITECH (the Health Information Technology for Economic and Clinical Health Act of 2009) and the regulations thereunder (including 45 CFR Sections 164.308, 164.310, 164.312, and 164.316) Suppose any part of these terms is held to be invalid or unenforceable, including, but not limited to, the warranty disclaimers and liability limitations set forth above. In that case, the invalid or unenforceable provision will be superseded by a valid, enforceable provision that most closely matches the original provision's intent and is nevertheless valid and enforceable. The remainder of these terms shall continue in effect. You may not assign any rights or obligations against Yoga Now without Yoga Now's prior written consent. Yoga Now reserves the right to transfer any right or obligation against you upon notice to you. Upon such assignment, the assignee shall be bound by the Terms in the same manner as Yoga Now, shall cease to have any liability to you. Yoga Now will endeavor to make its internal practices, books, and records that relate to the use and disclosure of PHI available to the US Secretary of Health and Human Services for purposes of determining Customer' compliance with HIPAA. Yoga Now shall not be responsible for any delay or deficiency due to any force majeure events such as natural disasters, acts of terrorism, civil labor strife, labor and transportation strikes.

Notice to California Residents

Suppose you are a California resident, under California Civil Code Section 1789.3. In that case, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing, currently to resolve a complaint regarding our Site or to receive further information regarding use of our Site. To make such a request, please call or send an e-mail. With the phrase “California Privacy Request” in the subject line of any e-mail request. We will respond to you within a reasonable time of your request.
